The GDPR

Like the Directive, Article 71 imposes on the European Data Protection Board the obligation to present an annual report on its activities. This report should address the protection of natural persons with respect to personal data processing in the Union and, where appropriate, in the third countries and international organizations.

This report must be communicated to the European Parliament, the Council and the Commission.

The annual report shall include a review of the practical application of the guidelines, recommendations and best practices referred to in point (1) of Article 70 (1) as well as of the binding decisions referred to in Article 65.

The Directive

Article 30 (6) of the Directive, required the Article 29 Working Party to draw up an annual report on the status of the protection of natural persons with respect to the personal data processing in the Community and in third countries. The report had to be published and communicated to the Commission, the European Parliament and the Council.

Potential issues

We do not see a priori any difficulties with this provision, which merely confirms an existing practice in most Member States.

Art. 71

1.   The Board shall draw up an annual report regarding the protection of natural persons with regard to processing in the Union and, where relevant, in third countries and international organisations. The report shall be made public and be transmitted to the European Parliament, to the Council and to the Commission.

2.   The annual report shall include a review of the practical application of the guidelines, recommendations and best practices referred to in point (l) of Article 70(1) as well as of the binding decisions referred to in Article 65.

1. The European Data Protection Board shall regularly and timely inform the Commission about the outcome of its activities. It shall draw up an annual report on the situation regarding the protection of natural persons with regard to the processing of personal data in the Union and in third countries.

The report shall include the review of the practical application of the guidelines, recommendations and best practices referred to in point (c) of Article 66(1).
