The GDPR

The Regulation vests three tasks in the Chair of the European Data Protection Board:

- to convene the meetings of the Board and prepare its agenda (a);

- to notify decisions adopted by the Board pursuant to Article 65 to the lead supervisory authority and the supervisory authorities concerned (b);

- to ensure the timely performance of the tasks of the Board, in particular in relation to the consistency mechanism referred to in Article 63 (c).

The Board shall lay down the allocation of tasks between the Chair and the deputy chairs in its rules of procedure (paragraph 2).

The Directive

Under the Directive, the Chair’s task was essentially to include in the agenda the matters to be considered by G29 (see Art. 29 (7)).

Potential issues

We do not see  a priori  any specific implementation difficulties.

Art. 74

1. The Chair shall have the following tasks:

(a) to convene the meetings of the Board and prepare its agenda;

(b) to notify decisions adopted by the Board pursuant to Article 65 to the lead supervisory authority and the supervisory authorities concerned;

(c) to ensure the timely performance of the tasks of the Board, in particular in relation to the consistency mechanism referred to in Article 63.

2. The Board shall lay down the allocation of tasks between the Chair and the deputy chairs in its rules of procedure.

Art. 70

1. The chair shall have the following tasks:

(a) to convene the meetings of the European Data Protection Board and prepare its agenda;

(b) to ensure the timely fulfilment of the tasks of the European Data Protection Board, in particular in relation to the consistency mechanism referred to in Article 57.

2. The European Data Protection Board shall lay down the attribution of tasks between the chair and the deputy chairpersons in its rules of procedure.

Art. 70

1. The chair shall have the following tasks:

(a) to convene the meetings of the European Data Protection Board and prepare its agenda;

(aa) to notify decisions adopted by the European Data Protection Board pursuant to Article 58a to the lead supervisory authority and the concerned supervisory authorities;

(b) to ensure the timely performance of the tasks of the European Data Protection Board, in particular in relation to the consistency mechanism referred to in Article 57.

2. The European Data Protection Board shall lay down the attribution of tasks between the chair and the deputy chairpersons in its rules of procedure.

7. The Working Party shall consider items placed on its agenda by its chairman, either on his own initiative or at the request of a representative of the supervisory authorities or at the Commission's request.
