The GDPR

Like the Directive, Article 87 allows the Member States to set specific conditions for the processing of a national identification number or of any other identifier of general application. 

The same provision states that the use of this identifier must be supported by appropriate safeguards designed to protect the rights and freedoms vested in the people affected by the Regulations.

In other words, the Member States are free to define the specific conditions for the processing of a national identification number or any other identifier of general application, provided that the rights and freedoms of the data subject pursuant to this Regulation are safeguarded.

The Directive

Pursuant to Article 8 (7) of the Directive, the Member States shall determine the conditions under which a national identification number or any other identifier of general application may be processed.

An example is that Belgian and French legislatures have adopted specific laws governing the consultation and the use of the National Register of Natural Persons, of the National Repertory of Identification of Natural Persons (RNIPP).

Potential issues

We do not see at first instance any particular difficulty of implementation when a specific system already exists in a Member State.

Art. 87

Member States may further determine the specific conditions for the processing of a national identification number or any other identifier of general application. 11. - (1)  Official authorities may process data concerning identification numbers with a view to unambiguous identification or as file numbers.

(2) Private individuals and bodies may process data concerning identification numbers where:

  1. this follows from law or regulations; or
  2. the data subject has given his explicit consent; or
  3. the processing is carried out solely for scientific or statistical purposes or if it is a matter of disclosing an identification number where such disclosure is a natural element of the ordinary operation of companies, etc. of the type mentioned and the disclosure is of decisive importance for an unambiguous identification of the data subject or the disclosure is demanded by an official authority.

(3) Irrespective of the provision laid down in subsection (2) 3, an identification number may not be made public without explicit consent.
